Terms of Service

These Terms of Service (the “Agreement”) form a legally binding agreement between you (“Customer”, “you”) and Dmitry Volchenko, Individual Entrepreneur (“ARPAI GEO”, “we”, “us”, “our”), governing your access to and use of the ARPAI GEO platform and services available at https://arpai-geo.com (the “Service”).

By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you enter into this Agreement on behalf of an organisation, you represent that you have authority to bind it. If you do not agree, you must not use the Service.

1. Who May Use the Service (Professional Use)

ARPAI GEO is a professional tool for brand, marketing, and AI-visibility analytics. It is offered for professional and business use only. You may use the Service whether you act as a company, a sole trader, or an individual professional (for example a freelancer, marketer, consultant, agency, or business owner), provided you use it in the course of your trade, business, or profession.

The Service is not intended for personal, household, or other consumer use. By creating an account you confirm that:

2. Description of the Service

2.1 Overview

ARPAI GEO is a software-as-a-service (SaaS) platform for monitoring and analysing brand visibility in AI-powered search engines (such as ChatGPT, Perplexity, Google AI/Gemini, and others). It provides tools for brand and product monitoring, competitor analysis, Share of Voice measurement, GEO audits, AI content generation, an AI traffic pixel, and related functionality.

2.2 Public-Source Data

The Service analyses information from publicly available sources (public websites and the responses generated by third-party AI engines). It is not designed to collect or process special categories of personal data, and you must not use it to do so.

2.3 AI-Generated Outputs

The Service uses artificial-intelligence technologies and third-party AI models to collect data, generate analytics, produce content, and provide recommendations. Outputs are machine-generated, probabilistic, and provided for informational and analytical purposes only.

You acknowledge that AI-generated outputs may contain inaccuracies, errors, outdated information, or omissions. Any use of outputs is at your sole risk. You will not rely on outputs as a sole source of truth or as a substitute for professional advice, and you are solely responsible for reviewing and verifying any output before acting on it, publishing it, or transmitting it to third parties.

In line with applicable AI-transparency rules (including Article 50 of the EU AI Act, applicable from 2 August 2026):

2.5 Third-Party AI Providers

The Service transmits queries to third-party AI providers (such as OpenAI, Perplexity, and Google) to collect and analyse responses. We do not control these providers and are not responsible for changes to, limitations of, outages of, or discontinuation of their services. Queries are limited to publicly available business information (such as brand names, websites, and locations) and do not include your account credentials.

2.6 No Guarantees

The Service is analytical and advisory. We do not guarantee any particular result, including changes in brand visibility, rankings, traffic, or other commercial outcomes. We do not provide advertising, placement, or guaranteed-promotion services.

3. Accounts and Acceptable Use

3.1 Registration and Security

You must register with accurate details (email, name, password) and keep your credentials confidential. You are responsible for all activity under your account and must notify us promptly of any suspected unauthorised access.

3.2 Authorised Users

You may allow your staff, contractors, or affiliates to use the Service on your behalf and may create separate projects for your own clients within your plan limits. You remain fully responsible for their actions and their compliance with this Agreement.

3.3 Restrictions

You must not: resell, lease, or sublicense the account to an unlimited group of persons; create multiple accounts to abuse limits or bonuses; place excessive load on the Service or disrupt it; copy, decompile, reverse-engineer, or extract the source code or create derivative products; or use the Service unlawfully or in breach of third-party rights.

3.4 Customer Content and Inputs

You are responsible for the data you enter and for ensuring you have the right to use it. You must not enter personal data of third parties into free-text fields (chats, queries, descriptions) without a lawful basis. We may apply automatic filtering, but responsibility for inputs rests with you.

4. Fees and Payment

4.1 Pay-As-You-Go

The Service operates on a prepaid, pay-as-you-go balance. You top up your balance and are charged per operation as described in the Service. Your balance does not expire.

4.2 Pricing

Prices for operations are displayed within the Service and on the pricing page and may be updated from time to time, with reasonable notice of material changes.

4.3 Payment Processing

Payments are processed by Robokassa (LLC “ROBOKASSA”), a licensed third-party payment aggregator. Your payment-card data is handled directly by the payment processor and is not stored on our servers. By making a payment you also agree to the payment processor’s terms. We accept Visa, Mastercard, and UnionPay issued by banks in many countries. Payments are taken on a prepaid basis.

4.4 Geographic Payment Restrictions

Due to payment-processor restrictions, cards issued by banks in certain countries may be temporarily declined. This is enforced at the payment-gateway level, is outside our control, and may change. If your card is affected, please contact us at welcome@arpai-geo.com.

4.5 Currency

Prices are displayed in US dollars (USD). The payment transaction may be processed in another currency (including Russian Rubles) at the exchange rate set by the payment processor at the time of the transaction. Any currency-conversion or bank fees are your responsibility.

4.6 Taxes

Prices are exclusive of any applicable taxes. Depending on your country and status, value-added tax (VAT), GST, or similar taxes may apply to your purchase. Unless we are legally required to collect such taxes and indicate them at checkout, you are responsible for accounting for any taxes due in your own jurisdiction. If you are a VAT-registered business and provide a valid VAT identification number, the reverse-charge mechanism may apply where available.

6. Intellectual Property

All rights in the Service — including software, design, databases, and algorithms — belong to us and are protected by applicable law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your professional purposes within your paid entitlements.

You retain rights in the data you submit. Outputs generated for you (reports, articles, strategies) may be used by you without restriction, provided you respect third-party rights. We do not use your account data or inputs to train AI models, and we do not claim ownership of the outputs delivered to you. Any feedback you provide may be used to improve the Service.

7. Data Protection

Our processing of personal data is governed by our Privacy Policy, which forms part of this Agreement. Where you provide us with personal data of your personnel or authorised users, you confirm you have a lawful basis to do so.

8. Disclaimer of Warranties

The Service and all outputs are provided “as is” and “as available”, without warranties of any kind, express or implied, including (to the maximum extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that outputs will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by law: we are not liable for the accuracy or timeliness of data from AI engines or other third parties; for outcomes of your use of outputs; for acts or changes of third-party AI providers or payment processors; or for loss of profit, loss of data, or indirect, incidental, special, or consequential damages. Our total aggregate liability arising out of or in connection with this Agreement is limited to the amount actually paid by you for the Service in the three (3) months preceding the event giving rise to the claim.

Nothing in this Agreement excludes or limits any liability that cannot lawfully be excluded or limited.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content or inputs, your breach of this Agreement, or your infringement of any third-party right or applicable law.

11. Suspension and Termination

You may terminate at any time by deleting your account or notifying us. We may suspend or terminate access where you breach this Agreement, where we reasonably suspect fraud or unauthorised use, or where required by law, giving notice where practicable. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive. Data deletion is handled as described in the Privacy Policy.

12. Changes to the Service and Terms

We may modify the Service and update this Agreement from time to time. The current version is published on the website with its effective date. Material changes will be notified by reasonable means. Continued use after changes take effect constitutes acceptance of the updated Agreement.

13. Governing Law and Disputes

This Agreement is governed by the laws of England and Wales, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The parties will first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice. If unresolved, the courts of England and Wales shall have non-exclusive jurisdiction. Either party may seek injunctive or equitable relief in any court of competent jurisdiction. Nothing here deprives you of any protection under mandatory law of your place of residence that cannot be derogated from by agreement.

14. Force Majeure

Neither party is liable for failure or delay caused by events beyond its reasonable control, including natural events, changes in law, regulatory measures, infrastructure or internet outages, or failures of third-party AI providers or payment systems.
